The short version: Be a decent human. Don't break things. Your data is yours. I'm one guy building this at 3am — I'll do my best, but I can't promise perfection. If something goes sideways, let's talk about it like adults.

01 — What This Is

3AM CEO (accessible at 3amceo.com and apps.3amceo.com) is a public platform built by David Birnie — a guy from Chatham, Ontario who builds businesses before sunrise. The platform includes a public challenge log, free productivity apps, and a dashboard for people following along.

By creating an account or using any part of this platform, you're agreeing to these Terms. If you don't agree, that's okay — but you probably shouldn't use the platform.

02 — Your Account

You're responsible for your account. That means:

03 — What You Can Do

You can use the apps for your own personal and business purposes. That's what they're built for. Use OAK to manage your tasks. Use the Idea Vault to capture your ideas. Track your habits. Build something real.

You can also follow the $20K Challenge publicly, share what you've learned, link to the site, and generally be part of the community.

04 — What You Can't Do

Don't be a jerk. More specifically:

Violations may result in your account being terminated. I'll use common sense about what warrants action — a typo in the chat isn't going to get you banned. Actual bad behaviour will.

05 — Your Data

What you put into the apps (your tasks, ideas, logs, goals) belongs to you. I'm not selling it. I'm not using it to train AI. I'm not reading your OAK tasks to figure out what products to pitch you.

That said — this platform runs on Firebase (Google's infrastructure). Your data is stored on their servers. By using this platform, you're also subject to Google's terms. Full privacy details are in the Privacy Policy.

If you delete your account, I'll remove your data from Firestore. Firebase backups may retain it briefly — that's on their end, not mine.

06 — The Newsletter

When you sign up, you agree to receive the 3AM CEO newsletter. Here's the honest truth about that: it doesn't fully exist yet. When it does, it'll be updates about the challenge, new apps, resources, and whatever I'm learning at 3am.

Every email will have an unsubscribe link. Use it anytime — no guilt, no hard feelings. Your consent is recorded with a timestamp in Firestore as required by Canada's Anti-Spam Legislation (CASL).

07 — Paid Tiers (Coming Soon)

Pro and Builder tiers are planned but not yet live. When they launch, payments will go through Gumroad. Tier details, pricing, and refund policies will be clearly stated at the point of purchase. Free tier stays free — that's a promise, not just a policy.

08 — Availability & Warranties

I'll do my best to keep the platform running reliably. But I'm one person, building this in a 2.5-hour window every morning before my day job starts. Outages will happen. Things will break. I'll fix them as fast as I can.

The platform is provided "as is." I can't guarantee 100% uptime, data accuracy, or that any particular feature will work perfectly at any given moment. For a free platform built at 3am — you probably expected this.

09 — Limitation of Liability

To the fullest extent permitted by Ontario law: David Birnie and 3AM CEO are not liable for any indirect, incidental, or consequential damages arising from your use of this platform. That includes lost data, lost business, or anything else in that category.

If something goes genuinely wrong and it's my fault, reach out. I'd rather fix it than argue about it.

10 — Changes to These Terms

I may update these Terms as the platform grows. When something significant changes, I'll post a notice in the dashboard. Continued use of the platform after changes means you've accepted the new terms.

Last major update: May 2026 (initial version — Skeets AI and safety clauses added May 2026).

11 — Termination

You can delete your account anytime. I can terminate accounts that violate these terms. In either case, your data gets removed from Firestore.

12 — Skeets AI Assistant — Use & Responsibilities

3AM CEO includes Skeets, an AI-powered assistant. By using Skeets, you agree to the following:

This platform includes automated safety features in the Skeets chat system:

14 — Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. If there's ever a dispute (hopefully there won't be), it'll be handled in Ontario.
